By accessing and using the SkyTalk Sim application and website (the "Service"), you agree to comply with and be bound by the following terms and conditions of use. Please read these terms carefully before using the Service.

2. Acceptance of Terms

By accessing and using the Service, you accept and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Service.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. During alpha or early access periods, access may be limited to invited participants or users with valid access codes.

4. Aviation Safety Disclaimer

SkyTalk Sim is a radio communication training simulator designed for educational purposes only. It does not replicate real air traffic control services and must never be used for actual flight operations or in-flight decision-making.

• This tool supplements but does not replace formal flight instruction from an FAA-certificated flight instructor (CFI).
• Scenarios may contain simplifications, inaccuracies, or deviations from real-world procedures for educational purposes.
• All procedures and phraseology should be verified against current FAA publications (AIM, ACs, NOTAMs) and confirmed with a qualified instructor before real-world application.

5. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Each account is for individual use only. You agree to provide accurate information during registration and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

6. Use of Content

Personal Use: The content provided through the Service, including scenarios, training materials, audio, and interface elements, is for your personal and non-commercial educational use only.

Copyright: All content is our property or the property of our content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or use any content without our explicit permission.

7. User Conduct

Lawful Use: You agree to use the Service only for lawful purposes.

Prohibited Actions: You are prohibited from posting or transmitting any unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable material, or from interfering with the proper functioning of the Service.

To the fullest extent permitted by law, SkyTalk Sim and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

You expressly acknowledge that the Service is a training simulation and assume all risk and responsibility for applying any skills, procedures, or information obtained through the Service in real-world aviation operations.

12. Indemnification

You agree to indemnify and hold us harmless from and against any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the Service (for example, by requiring re-acceptance upon login) and update the "Last Updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
